Medical Malpractice Defense

One of our specialties is the defense of medical malpractice litigation. Over the years, we have developed an expertise in defending both physicians and hospitals. The firm of Furey, Kerley Walsh, Matera and Cinquemani, P.C. provides services for physicians insured by American International Group, Academic Health Professionals Insurance Association, Medical Liability Mutual Insurance Company and Physicians Reciprocal Insurers. In addition, our firm provides services to hospitals such as Brookhaven Memorial Hospital Medical Center, Central Suffolk Hospital, Huntington Hospital, Nassau University Medical Center, New Island Hospital, New York Methodist Hospital, North Shore University Hospital and Winthrop University Hospital. It is our belief that through our representation of both self-insured and insured clients, our attorneys have developed a flexible, responsive, personalized approach to the practice of law that benefits our clients in providing excellent service coupled with excellent results.

It has become apparent to health care providers that the costs associated with medical malpractice claims are substantial. In some instances, this cost represents as much as 10% of a hospital's budget. Sophisticated health care providers have come to recognize that in order to meet the problems associated with the medical malpractice situation, it is necessary to secure the services of a law firm not only well experienced in such matters, but one which also has the resources necessary to provide appropriate representation.

"A specialized hospital-medical malpractice law firm should be the first choice of Risk Managers ... 'The increased expertise of plaintiffs' attorneys is putting the burden on us to do better in the defense area ... We have to have specialists defending us.' In the past, hospitals have selected defense counsel on the basis of location ... Hospitals have picked legal firms even if they weren't specialists in malpractice ... 'But we're in a different ball game today. The specialized plaintiffs' firm, the traveling road show is coming into town'." Hospital Risk Management, October 1985 (Emphasis Added.)
